It's CAA guidance I think, not the Regulation (not EC 261 in any case). I've had an impression that this interpretation was different from case law which was often leaning towards "freak weather accident" so something that is truly outside of an airline's control (just like an inherent manufacturing defect vs. regular "tech"). Not saying any type of weather is within an airline's control, but having de-icing equipment compatible with normal winter conditions is.
