As far as I know the decision to land after curfew is at least in part made by the carrier. That is, the airport is not closed and ATC does not have the authority to deny landing to any aircraft. Landing after curfew incurs a fine, and the waiver is for the fine, not for the landing itself. Perhaps someone more knowledgeable can correct me if I am wrong.
