I guess the one situation where it could be borderline is if a well-intentioned family member or similar wanted to give someone a gift of an upgrade and didn't know if legitimate means to do so and saw this on Craigslist. They purchase to apply to someone else's ticket, and the traveler/member gets incorrectly busted.
