The legislation will not change until there are provable deaths - and the subsequent public inquiry calls for those changes to become mandatory, its a lifeboat on the Titanic situation.

That said, the brace position is designed to stop you whipping around like a rag doll in a rapid deceleration. Aspects of it are very important like the feet aft of the knees and one hand over the other over your head. Leaning forward with head against the seat back in front of you is sufficient. At 6,4 I have no issues even in the cramped seats - it's not comfortable but it's more than possible.
