The question everyone has failed to ask is whether these folk boarded the Delta flight using Delta miles earned with an AMEX card. Under the current AMEX RAT directives AMEX can shut down credit cards if any user “have engaged in abuse, misuse, or gaming in connection with earning or USING POINTS.” If these folks are charged and convicted for their behavior then the AMEX RAT may bite them.
