Ofcom, and its ugly sister the PSA, have powers to prosecute and to issue substantial fines to business who do not conform to, or otherwise do not operate within the requirements of, the various telecommunications regulations.
They may have the power, but they tend not to use it and most companies aren't too worried about them.
BA is a great example actually - they didn't bother complying properly with the new rules requiring companies to have a non-premium number for post-sales calls, there was no intervention by any agencies and it took a Flyertalk thread for BA to comply.
