What are the actual legal implications in case of an accident if you drive a rental but are not a registered driver?

We often rent cars and I am the usually the driver. If I turn the car over to Mrs. michaelr (let's assume, I am in the car with her), and she gets into an accident. The rental contract has been clearly violated, however, she should still be protected by her own car insurance, no?
