Bear in mind that even if you do win in the end, you are likely to need your own lawyer and the cost of those legal fees could well exceed anything you might avoid paying the individual.
I completely agree with Often1 on this matter. There is no protection that a well intentioned passenger can count on. What he could count on is being involved in a suit, depositions and potential legal expenses.

That said, this thread has absolutely nothing specific to do with DL despite the fact that the OP put "DL" into his title. I am surprised that it hasn't been moved to somewhere more appropriate.
