Hotels usually do have that explicitly in writing and usually when you decide to stay at that hotel you have agreed to the term. You did not think large corporations like Hilton did not run such documents through their in-house corporate lawyers, didn’t you?
Many jurisdictions have consumer protection laws and small claims tribunals which protect against the sort of contract you say Hilton might have. If they are "guilty as charged" the consumer would be the winner and no organization of Hilton's standing would want this type of adverse publicity.
