If your WT+ to CW upgrade target is not eligible for upgrade (low down the DUT order) then the agent could simply respond "I'm afraid that seat is not available, I can offer you <seat of person high up the DUT list>?"

So BA could clearly defeat this if they wished, but the scheme seems so contrived that I doubt anyone does it in practice.
