You can always tell the check-in clerk that you won't be carrying that bag with you to the plane. They have no way to tell and can't forcefully weight a bag you have on you at check-in time.
This said, I'd advise against placing an overweight bag in the overhead bin. Keep it under the seat in front of you for the sake of everyone's safety. (Hope this doesn't sound condescending, not my intention.)
