I tend to disagree. It is the customer's fault for not having a chipped card. I mean they aren't hard to get... You can get a replacement from your bank, usually without a fee. Every card in my wallet has a chip, and there's a lot of them. I told Key Bank I lost my card and they overnight-ed a debit card for free, with a chip. I'm sure they would've replaced my card upon request anyways.
If you have a bank that's too lazy to roll out EMV cards when the liability shift was a year and a half ago, I think the real question is, why do you bank with a financial institution with that attitude?
