I'm still pursuing a EC/261 claim from July for a 3 hour delay from JFK to LHR but I am finding BA's behaviour strange to say the least.
I am dealing with a chap from the GGL team. Average response time from him is about 3-4 weeks. He rejected my claim early November due to weather but I could find no abnormal weather in the NYC or LHR areas and no consistent pattern of delays on other flights.
I went back to BA and asked for details of the extreme meteorological conditions and then silence again for 3 weeks. Nudged again and the reply was strange. Basically he said that as the plane left the gate at JFK on time then the delay must be a result of weather or ATC for which BA are not liable. But he had no details of what had caused the delay after 5 months. I checked my notes and the flight was over an hour late leaving the gate and no weather issues were mentioned by the pilot.
I can only assume that BA staff are instructed to stall EC/261 claims without providing a truthful response or even investigating a claim properly.
I have now asked for the Flight Investigation Team to look at the flight. I have been told this will take about 2 months!
