This weekend the top floor was still open - I do not think that they would easily be closing that section down as it means closing McD as well.
As for seating: I strongly prefer a seat on row 5 (or below) as they offer more legroom (maybe not as much as the exit row, but still more than regular economy). Sitting up front has the advantage of being able to quickly leave the aircraft upon arrival. But like with many things - its personal preference.
If you do online check in 48 hour before the flight pretty much all seats should be available, very very few people do advance reservations. Keep in mind that you may have to do check-in twice: Once at 48 hours before the first flight, and once 48 hours before the second. Or do it only once at 48 hours before the second flight, but run the chance the best seats have already been taken on the first flight.
