Max time before bags are declared "lost"?

Hello, hopefully I am posting this in the correct place. I flew Qantas from Melbourne to Manilla (via Sydney), and they lost my checked bag. I filled out a PIR form at the airport and have remained in constant communication with them.

My main problem is that it has been over 2 months since this flight and Qantas will still not declare my bag "lost" - they just keep saying they are looking for it. I do have travel insurance, but I do not think I can file a lost baggage claim until they admit it is gone. The claims department is also being fairly difficult/non-responsive, since they agreed to pay for some of the delayed baggage reimbursement, but then they sent me the wrong form and since have not replied back to me.

Is there any rule/law, like in the Montreal Convention, that states the time period before an airline MUST declare a bag "lost"? Or can Qantas literally search for this bag for a few more months?
