Have the cord of the headphones pulled out of the device... and have the end of it in an obvious, visible place... like on your lap...
When the F/A asks you to turn off/take off your headphones.. you point to the end of the cord.. say you understand the regulation and you would like to use your headphones as "earplugs" until you reach 10,000 feet...
Or is that too practical an idea?
I've tried it several times, showing them the light's off on the little box, and the cord's not plugged into anything, and they STILL tell me to stow it.
