Hi, we recently traveled from Mumbai(India) airport to EWR(NJ), upon arrival at the bag collection belt there was officer standing at our bag, she asked us if there is any apple in the bag as beagle sniffed it, we said there could be one, it's for kid, then she asked any other food like, chick peas or peanuts etc..we said No, then she has written apple on the cbp declaration form (our declaration form has NO for all items listed), then we were sent to bag inspection, there the bags were checked, there were couple of berries in check-in bag which we forgot completely to mention, it was more than 24 hours flight and we really did not remember there were few there in bag, there were approx 6 bags and were packed with the help our relatives, they had put them in there, ya but it's our mistake we forgot to mention. The CBP officer said, we have to pay fine of $300, we pleaded enough that it's first time violation, but she said she can't waive off fine. I believe the officer entered our passport information in their system, he was mentioning we/i could be sent to bag inspection in future travel and told us send money order giving notice of alleged violation-591 form (hand filled by officer) and asked to send these to along with money order. I sent money order and confirmed with cbp that they recieved it. Here are my questions, please answer.
1) The violation notice is given to me (on my name and passport), it means it's only me who will be going for bag inspection in future or my wife also has to go? any idea? i remember the officer collected our both passports and said kid's passport is not required.
2) Will this be red flag and shown in visa officer computers when i go for visa stamping in future in india.?
3) I know, it's minor violation, but is this needs to mention in any forms like, Green card application(I485), the question is like-
Have you ever, in or outside the United States: Been arrested, cited, charged, indicted, convicted, fined, or imprisoned for breaking or violating any law or ordinance, excluding traffic violations?"
