Qantas (illegally?) attempting to limit compensation for lost baggage

Hi guys,

I would like to know what FF's experience has been with compensation for lost baggage.

As per the Montreal Convention (which Qantas is bound to), the airline is supposed to declare a piece of baggage lost after 21 days.

We are past this deadline and QF offered a settlement of the loss. They have purposely excluded some electronics that I had in the lost bag. See the excerpt from a Customer Service representative:

Under Conditions of Carriage, the Carrier is not liable for loss of money, jewellery or valuable items such as cameras and electronic equipment, included in passenger baggage, with or without the knowledge of the Carrier.

7.4 Restrictions on Checked Baggage
You must not include in Your Checked Baggage:
• fragile, delicate or perishable items
• computers
• items with a special value, such as money, jewellery, precious metals, silverware
• negotiable papers, share certificates, securities or other valuable documents
• cameras
• personal electronic equipment including compact discs
• commercial goods or business documents, or passports and other travel documents
While this is not the first time I experience losing a bag, it is the first time I see this kind of exclusion.

Indeed, there is no provision in the Montreal convention for the carrier to enforce a restriction.

Has anyone been successful in getting Qantas to 'see the light'?
