There is no formal grandfathering per say. These requirements are for acquirers as they are ultimately responsible for the equipment used to process transactions.
Any active US contactless terminals not capable of qVSDC/EMV, and any US merchant locations that accept EMV contact but only MSD contactless are non-compliant, full stop.
Any enforcement actions around this (like any other requirements) would be taken by Visa at the acquirer level, and would likely see the acquirer submitting an 'action plan' of how and when they intend to get into compliance.
