make sure you state that its a formal complaint. If they reject your complaint you may be able to approach the Financial Ombudsman Service because there is a financial / insurance dimension to this.
Thanks Peter and IAHtraveler for the advice. Yes it is a rental company in the UK.
Here's the relevant clause in the agreement which they claim entitles them to keep the full amount of the excess: "I agree to pay the agreed excess of GBP750 for each and every incident to the vehicle". They also claim that any difference ie the GBP500 owed to me, is used to cover the loss of earnings to the rental car company.
I am keen to pursue the matter further, but is it a common practice in the rental industry to refund the difference? Is there some law or regulation saying that the difference should be returned to me? I am thinking that the rental car company will use the clause in the agreement to justify that I have no claim to the difference.
