As far as I understand it, it's the TSA that will be running the program and the airlines that will only be providing information necessary to run the background checks. Therefore, if a gov't agency (the TSA) runs the background and finds a flaw with your record, I would assume the gov't (whoever has jurisdiction over the person in question, e.g., if it's a state warrant, state police/federal warrant, federal police) would come and get ya.
