IMHO small claims court will get you more than CTA. Nothing like forcing a bunch of people from all three airlines to respond and perhaps show up or represent in small claims. They will do a cost analysis on time required plus possible outcome and will come to the conclusion that it is cheaper to settle. They will otherwise have a fine old time trying to finger point in front of a court when they all know the judgement will favor you based on the facts presented.
Have never been the route of small court or the CTA before, so not sure what to expect. wrt to small claims court, I guess I will need to fie a claim against ALL three airlines? I have NOT been able to ascertain in clear terms as to which airline owns the responsibility. Swiss has offered refund of bus fare and a token amount of $45.00 per person in coupons, LH says that it is AC and AC says that we were late for the flight, which as I mentioned in earlier posts not to be true and can be easily proven. Will the small claims court decide which airline is at fault? They would need to decipher through loads of documentation to do so!! SWISS and LH I don't think even have offices in Ottawa. Would I have to file in Montreal where they have offices or can I do it in Ottawa!! I will try to read up more on it but if any one has done this before, please provide some guidance!! thanks ....
