Did they pay the $400 by credit card? As somebody said up thread, that would be your easiest way of getting your money back, to dispute the charge on your statement and let Amex argue it with BA/IB if they can be bothered.
I would doubt that American Express would even accept the submission of a dispute on this.
The passenger chose to check in luggage and was charged for checking in the luggage by exactly the amount due.
The reason why he checked the bags in was nothing to do with BA
