To the OP: Take the money and run. Do not ever use ACV again. Share your experience with ACV with others so they don't make the same mistake of trusting ACV.
You flew knowing that the air arrangements were wonky and you remained in Mexico despite being screwed over. As such, you did use some services. ACV is offering you its markup on the package it sold you. It has no pull with the slimy Mexican hotel. Cancun is notorious for these types of ripoffs and the abuse of foreign tourists. Why people still travel to ripoff tourist zones in Mexico despite the extensive media coverage of these rip offs is beyond me. Take whatever you can and walk away.
CC companies may be reluctant to just take the one side for an amount this large for a partially subjective claim. Yes, they will call it a "merchant dispute" because that is what a charge back is based upon.
The issue is services "not substantially as agreed and paid for" whether some were used may sway the amount in question but not the substance or validity of the dispute.
ACV is the agent and is specifically responsible for delivery of the whole package by regulation in several Provinces (not sure where OP bought the package). The pull ACV has is by delisting the resort from their packages.
Blaming the victim is not on. Yes, Mexico is not perfect but millions travel there every year without issue.
