There is the Criminal Code offense of "Criminal Negligence Causing Bodily Harm". But that's probably something pretty hard to prove. Taking off knowing there's ice on the wings, or deliberately descending below legal minimums might fit the description, but from all the media reports thus far, the pilots themselves were completely oblivious to their fate until the plane smacked the lights.
I suspect if the TSB report looks really, really bad for the pilots, that AC will fire them. ACPA will grieve, and the matter will spend a year or two in arbitration before they're ultimately given their jobs back.
