This happened to me a couple of weeks ago, I said to the guy "1C? I believe that's my seat", and he instantly got up and moved elsewhere. Any sign of resistance, however, and I would have gone straight to the FA. This guy clearly knew what he was doing, I suspect he was hoping the seat would remain empty.

I really dislike taking a seat that has been pre-warmed by somebody else's rear end
