What would you have done in that situation? Had it been me and had it bothered me, I would have mentioned it to the crew which seems to me to be the reasonable thing to do in the situation.
I never knew that in this context 'I'm sure' actually conveys that you are stating a fact. I always thought it meant 'with a great degree of confidence' or 'it seems very likely that'. English is a literal language. I must remember that when someone says 'Yes. Very good. Ah welll...".
I would have fallen asleep probably. Normally when I am bothered, I do speak up. If I see someone already talking to the crew then maybe I wait a bit. However, I would be surprised if only people who brought it up during the flight would be compensated if it was indeed a defect.
