I don't think so. Article 3 covers scope. Para 2 requires passengers present themselves for check in at the time required by the airline (unless the flight is cancelled) or have been transferred by the airline to another flight.
You may still be able to get a refund (or part refund or credit to a future flight) depending on fare rules, the airline's contract of carriage, and/or the goodwill of the airline.
