The reason I ask is that my father does not want to take the second leg, and leave directly from Newark. I will continue to another flight. He's also booked on that flight and he will need his baggage. Unfortunately, due to the way the travel agency books the tickets, there is no way for them to cancel his second leg. If he has to claim his baggage before reentering security, he would just leave.
Since EWR will be your first point of entry into the US, you will need to clear immigration and customs (collect bags). They will not be checked through (unless you clear immigration and customs before you arrive, but Scotland is not one of those locations).
