What's the court case for EU261 comp for non-cash upgrades?
Ticketed fare class.
As to GPU's (or other certificates, there is no reported EC 261/2004 downgrade case. I presume that UA would simply redeposit the GPU rather than argue about how one calculates 75% of a GPU. That leaves the passenger with no argument as the passenger has 100% of it. Unlike cash and miles, there's no real way to divide a certificate.
Still doesn't get UA out from under 75% of the underlying cash ticket. The issue still remains as to whether it's 75% of the entire ticket or the ticket for the segment in question. I suspect that if this ever gets resolved in a court where precedent matters, it will be 75% of the ticket for the segment.
