Yeah, just because they say it, it doesn't make it so.
It's like when you buy a ski lift ticket and scrawled in minscule writing on the back of the ticket are all sorts of claimed limitations to the operator's liabilities. They can declare that the are under no obligation to pay, care, or notice if you die on one of their delapidated lifts, but that doesn't absolve them of their legal responsibility to keep their equipment in good repair and compensate you if their failure to do so results in your injury.
Likewise for this shabby hotel! They can claim you are paying them just because you are kind, and in return they owe you nothing like safe, clean accommodation. But I'm guessing the courts will decide otherwise.
