Steve, I'm not sure you would. Excess baggage weight fees aren't federally mandated. I'm no expert on federal preemption, but I think it would be something of a stretch to say that because airlines are overseen by the FAA, there would be federal preemption. I look at the scales more as a part of the airport than the airline. As such, the local laws would apply (ie: in Los Angeles, the county health department inspects the food service providers in the airport). Again, it's been years since I really thought about federal preemption, so I'm probably wrong.
