If you meant inbound to the US (i.e leaving the EU) then EU261 does apply to non EU airlines.
If you meant inbound into the EU then it doesn't
So for example
DL31 LHR-ATL EU 261 applies but DL30 ATL-LHR it doesn't.
But fly VS ATL-LHR then it does apply as VS is an EU airline.
BUT EU261 does not mention names changes (topic of this thread) in the current iteration but if proposed changes are agreed then airlines would have to permit name corrections without a fee but this would still only be for correcting typos not for an entire name change.
Sorry for not being clear as I was thinking in-bound back to US when out bound going to Europe. So we are on the same page but that's why I said having a good consumer protection can be one reason for me to book on a EU carrier
