I think that if you are capable of "providing assistance w/ crewmember in the event of an emergency" anyone can sit there.

Usually an airline's Frequent Flyers (certain levels) are able to pre-confirm Exit Row seats, while for "first-time flyers" you may only be able to get the seat at check-in.
