From a legal/regulatotry point of view, a CEO cannot just casually make some hints to antitrust issues in a tone in which a movie start would announce that he's been secretely dating another star without the public knowing it. If the CEO knows about antitrust issues that are being investigated or are likely to be investigated once they are known about then there is a pretty well scripted procedure to follow in terms of communications to various stakeholders (regulators, stock exchange, etc.) "Disclosing" doesn't necessarily mean making this a main agenda point during a results release press conference, but it has to be properly disclosed, with rules about how much has to be said and what things do not have to be said. But just saying "there is something in our relationship with a competitor" AFAIK is not what he could do when it's actually about an antitrust issue that is being investigated or likely to be investigated when disclosed.

Lawyers please step forward, this is your domain (I can only deal with the economics behind it ;-) )
