No penalty, other than being yelled at a lot. You obtain the ETA, but present the Oz passport at Immigration in Australia. And then do some explaining to the probably unimpressed IO. The difference between presenting to an airline for travel and presenting to Immigration for entry.
I don't understand why people put themselves through that sort of self-inflicted BS though. If you want to use the passport then the cost of renewing it is part of the whole deal.
