In all fairness, I don't see how this is an AVIS scam.
It's a scam since they knew there was pre-existing damage to the car and are trying to fool someone into paying for it. Revenue enhancement, pure and simple. Unfortunately, the OP was rushed and forgot to check.
Years ago, the rental companies didn't try this nearly as often.
