There is no Federal Regulation requiring window shades be up or down, however the Cabin Safety Compendium (December 2001) to the Operator's Flight Safety Handbook published by the Flight Safety Foundation does list "Opening window shades fully" as part of their items that the cabin crew should instruct the passengers to do during the safety demonstration.
