Given that much of life consists of 'unpleasant and stressful' situations for which you get no compensation at all, I'd take the 40k and run.

Of course you can probably squeeze more out of them but the reality is that businesses do consider complaint history when making these decisions so your pushiness now could have a negative effect down the line.
