The photographer holds the copyright unless he/she relinquishes that. The rights to use the images commercially are different. When you are in a public place then you generally have the right to use it. When you are on private property then commercial use rights can be more tricky. I wouldn't think that BA would have an issue, but strictly it can reserve the rights to any photography, particularly in a commercial sense.
