We had an interesting debate some years ago at work about compensation due for a significantly delayed train, which resulted in £300 compensation. We ended up agreeing that if the delay was in work time, and didn't inconvenience you as an employee because you would have been at work anyway, the compensation would have gone to the employer. If you were travelling at the very end of the work day and you were late getting home as a result, then the compensation went to the employee.
I appreciate that no system is completely fair and transparent, but this seemed reasonable to me.
