This is still happening. Last night, 1869 from MCO, pax in row 4 (old 319 config) moves to row 3 before departure (I was seated in Y). Crew doesn't notice so I very discreetly and politely tell the FA about it and that I don't think I don't think it's fair to the paying J pax (let alone the upgraders). She agrees, thanks me and tells the SD. Nothing gets done. Pax stays up front and gets full service. To his credit, I doubt he knew what he was doing because the rows look the same. It was pretty obvious he didn't fly much. So disappointed the crew didn't take the initiative to enforce it.
