Just to follow up, after I PM-ed Gold Passport here about inappropriate breakfast charges, they sent a message to the PHNY Front Office management asking them to follow up with me. A few days later, the PHNY team did indeed reach out to me and refunded the overages. It took several days, but I should at least give them credit for making it right (eventually).
There is still no excuse that this even happened. T&Cs are very clear that complimentary breakfast includes all gratuities and charges.
