Why should I sugarcoat a bad situation? What OP proposes (refuse to vacate his room when he does not have a reservation on the 2nd night for the same room) is indeed illegal and could lead to the outcome described in my post. It gives the truth instead of meaningless babbling on irrelevant subject. And now may be you can read the statutes to get an understanding yourself since you seem to side with the OP, who does not think his proposed action being unethical or illegal. Ethic aside, the illegal act part should not have any more question.
It's illegal in some states, perfectly legal (but the hotel can charge full rack rate) in others. I've seen the latter happen, when a convention tried to hold over several days in Phoenix in the summer; the first was no problem, but the second was when another convention (the one I was attending) was being held. The hotel told them they'd have to pay full Winter Rack Rate; they left.
