LH doesn't set the MPM for a route, the city pair MPM is pretty much industry standard with a few variations depending on the travel direction, or if some carriers refuse to update MPM changes. Its not up to them as far as I know. Now it IS their fault for not specifying a direct routing which would price.

If publishing fares that won't price (which is usually unintentional) was illegal every airline out there would be guilty. But they don't do it intentionally AFAIK.
