I'm pretty sure the Chinese Gov't only has jurisdiction to whether or not the flight itself operates, not what the fare is. Just like most other int'l flights, they are 'subject to gov't approval'.
I'm not exactly sure how it works with Open Skies, but int'l fares did need to be approved in the old days. I doubt it works that way today. But are the Chinese like the DOT and have "operators standing by" to process this?
