This is incorrect and will vary from jurisdiction to jurisdiction. That is why multiple posts in this thread make it clear that there are no broad pronouncements which can be said to make this practice criminal or not or which could create civil liability for the individual stalker or, if the stalker is on a business trip, the stalker's employer.

The first step answer here is really simple. Before you do this, get the advice of a lawyer who practices in the specific jurisdiction.
