I just tried a dummy booking for a domestic non-BE routing.

I got all the way to the Purchase Now (your credit card will be charged now) step and then aborted the process.

At that step, however, there was this message displayed:

"When you click Purchase Now you agree to all Fare Rules for each flight & all terms in Delta's applicable Contract of Carriage opens in new window. Once your ticket is purchased, Risk-Free Cancellation opens in new window may apply. No contract exists until you receive confirmation that payment was received and processed. Your credit/debit card will be charged at this time. The transaction may take up to 3 minutes, so please be patient."

Is this the sort of message you saw, or was there a separate button that had to be clicked to affirm acceptance of the CoC before you could click the Purchase Now button?

There are a lot of Mother ATL enablers here who like to puff about the fact that if you buy the ticket, you have agreed to the CoC.

But, contrast this with downloading a free software upgrade. I have never completed that process without having to click a button to positively affirm that I am agreeing to the licensing requirements.

More significantly, above that button is (90+% of the time) a window where I can scroll through and read the licensing agreement.

If the purchase of a BE ticket from JFK to LAX requires the positive affirmation, in addition to what I saw, it is likely because they have received so much blowback about aircraft substitutions that they feel they need the extra layer of protection.
