3. However if you refuse the Y offer and pay for J, they should refund you the difference, probably plus costs. Especially if not in small claimscourt. In which case I would imagine the costs would include the lawyer.

This said, I suspect that if one would file a law suit, they would quickly settle and not let the thing end up in court. No precedent, no bad publicity, no costs associated with lawyer etc for losing anyway.
