Resetting 90 days under US Visa Waiver Program
Anyone have an recent experience with a foreign visitor to the U.S. under the 90 day visa waiver program leaving and coming back to U.S. to get a new 90 day period?
We have a Swiss citizen staying with us to do networking and career development. She will probably be doing some travel into and out of the U.S. perhaps as far as Asia and perhaps only as far as neccesary to reset the 90 day counter.
As I have been reading and researching, it appears that one key thing to do is to ensure that, when you are entering, to have a return or exit flight withing 90 days booked and handy.
But how likely is the immigration officer to look through the passport and note that the person had just left a few days ago and was now coming back? And do they care that much where the person came and went from?
Imagine a travel pattern like this:
Day 1: Switizerland to US.
Day 80: US to Costa Rica
Day 89: Costa Rica to US
Day 170: US to Switzerland
This would like an effort to evade the 90 day rule I think.
But, does a foreign visitor get checked when leaving the US? They don't right? So the real risk is whether the visitor gets in trouble or otherwise entangled with immigration while she is here and past 90 days from the original entry date right?
